If your premises have closed, have you thought about suspending the rent?
The Government of Spain has decreed the suspension of activity and closure of certain premises open to the public in Royal Decree 463/2020, of March 14, declaring a state of alarm for the management of the health crisis situation caused by COVID-19, which is applicable immediately, in principle, until March 29, which will certainly be extended.
In this situation, TOURISM & LAW is considering the possibility that the tenants of business premises may also suspend the payment of rent to the owner of the business premises due to COVID-19.
What reasons can we legally allege? Is it an extraordinary and unavoidable circumstance? Is it a force majeure? What is the difference between them? What is the most appropriate way to avoid this situation?
